Cookeville sued in federal court over fourth amendment violation, unpaid bill
Cookeville City Mismanager Jimbo Shipley could have paid $20 for a subscription to The Putnam Pit, but noooooooo, that would have been honest. Instead, he has hired a fancy-pants Knoxville lawyer to defend his actions -- at your expense. |
"It is utterly unbelievable,
reckless, sloppy and a failure to the entire judicial system that, given
two documented instances of presenting false information to the courts,
the Magistrate Judge would plow ahead and incorporate this fraud into his
Finding of Facts."
PLAINTIFF'S
OBJECTIONS TO MAGISTRATE JUDGE'S REPORT AND RECOMMENDATION
The Court has before it the defendants' motion (filed July 20, 1998; Docket Entry No. 30) for summary judgment; their memorandum (Docket Entry No. 31) in support; and the plaintiffs' response (filed August 10, 1998; Docket Entry No. 36). The Court has subject matter jurisdiction over the plaintiffs' federal claims under 42 U.S.C. § 1983, pursuant to 28 U.S.C. § 1343. For the reasons discussed below, the defendants' motion for summary judgment will be granted as to the federal claims. The state law claim under the Tennessee Public Records Act will be dismissed without prejudice. |
