MOTION TO COMPEL WILLIAM GIBSON TO GIVE VOICE EXEMPLAR
Comes the defendant, Byron Looper, by and through counsel, Douglas A. Trant, to move the Court to order William Gibson to provide a voice exemplar to Joel Charles, an audio and voice expert. The Defendant would incorporate by reference a letter sent to Mr. Gibson by fax with the original to follow in the mail on February 10, 1999, and which is attached to this motion. During a telephone conference with the Honorable J. S. Daniel on an emergency application for a gag order by the State upon their having received notice of a planned press conference as to this very issue by counsel for the Defendant, Mr. Gibson stated that he would not voluntarily provide a voice exemplar in this case. Because of the grave issues in this case which, if were found to true, would raise serious implications about the illegal and misuse of office by Mr. Gibson and because there would be relatively no imposition on Mr. Gibson to spend a few minutes on the telephone to provide a voice exemplar if he did not ask Mr. Dedmon to set up Byron Looper.The Defendant would ask the Court to order Mr. Gibson to provide the voice exemplar as requested to Mr. Charles. Mr. Gibson could certainly have his voice and the tape analyzed by anyone else that he chose as well, The Defendant simply wants to get to the truth in this matter. If the voice on the tape identified by Mr. let mDedmon is Mr. Gibson and is asking Mr. Dedmon to illegally set up Mr. Looper, that matter is very material to these [proceedings.]
